Welcome to the GapStation Terms of Service. These terms constitute a legal agreement between you and GapStation ("we," "us," "our"), a company registered in Canada, that govern your use of our application and services.

2. Eligibility and Account:

   · Minimum Age: To use our Services, you must be at least 18 years of age and have the legal capacity to enter into a contract.

   · Identity Verification (KYC/AML): To comply with Canadian regulations (Know Your Customer and Anti-Money Laundering procedures), users will be required to verify their identity by providing information/documentation before using certain features.

   · Account Security: You are responsible for maintaining the confidentiality of your login credentials (email, password, 2FA). Any activity under your account is your responsibility.

3. Service Description:

   · Clear explanation that the App is a platform that facilitates the conversion of traditional funds and cryptocurrencies into a native token and vice versa, for use in transactions.

   · Critical Disclosure: It should be clarified that we are NOT a bank. The funds in your account are held in custody by us but do not constitute a deposit insured by the Canada Deposit Insurance Corporation (CDIC). The native token is a utility within our ecosystem, not legal tender.

4. Transactions and Fees:

   · The conversion, purchase, sale, and transfer process will be detailed.

   · All applicable fees (transaction fees, conversion fees, and blockchain network fees) will be transparently disclosed.

   · It will be established that blockchain transactions are irrevocable once confirmed.

5. Intellectual Property:

   · All rights to the App, logo, code, design, and native token are owned by GapStation or its licensors.

6. Limitation of Liability:

   · Risks of Blockchain Technology: Users will be warned about the risks inherent to blockchain technology, including cryptocurrency volatility, regulatory changes, network failures, and the irreversibility of transactions.

   · Maximum Liability: A limit will be established on the company's liability in the event of losses.

7. Applicable Law and Jurisdiction:

   · These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the applicable laws of Canada.

   · Any dispute shall be submitted to the competent courts of Quebec.

8. Modifications:

   · We reserve the right to modify these Terms. Users will be notified of changes, and their continued use of the App will constitute acceptance of the new terms.


 GapStation Privacy Policy

 Introduction: At GapStation, we protect your privacy and personal data. This policy describes how we collect, use, and disclose your information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable provincial laws.

   · Legal Compliance (KYC/AML): Verifying your identity, preventing fraud, money laundering, and countering terrorist financing, as required by Canadian law.

   · Communications: Send transaction notifications, security updates, and responses to your support inquiries.

   · Service Improvement: Analyze App usage (anonymously or in aggregate) to improve our functionality.

3. Disclosure to Third Parties:

   · Payment Service Providers: Banks, credit card processors (Stripe, etc.).

   · Identity Verification Providers: Third-party services specializing in KYC/AML.

   · Regulatory and Legal Authorities: When necessary to comply with a Canadian legal obligation, regulation, or legal process.

   · Blockchain Partners: The nature of blockchain technology means that some transactions (public addresses and amounts) are visible on a public ledger, although they are not usually directly linked to your identity.

4. International Transfers:

   · If providers outside of Canada are used (e.g., servers in the US), it will be explained that the data is subject to the laws of that country. Measures will be taken to ensure an adequate level of protection.

5. User Rights (under PIPEDA):

   · Access and Correction: You have the right to access your personal data that we hold and to request correction of any errors.

   · Withdrawal of Consent: You can withdraw your consent for certain uses of your data (e.g., marketing) by contacting us. Note: We cannot provide the service without the necessary data for KYC and transactions.

6. Security:

   · We will retain your personal data for as long as necessary to fulfill the purposes described and, crucially, to comply with our legal obligations regarding financial record retention and KYC/AML (which in Canada is typically 5 to 7 years after you close your account).

 

Transaction and Refund Policy

Important: Given the nature of your service (digital and irreversible blockchain transactions), a traditional "refund" policy does not apply. Instead, your focus should be on reversing erroneous transactions and cancellation policies.

 1. Irreversible Nature of Transactions:

   · It will be made absolutely clear that transactions executed on the blockchain (sending crypto or native tokens to external addresses) are irrevocable and non-refundable once confirmed by the network. It is the user's responsibility to verify the destination address.

2. Reversal of Transactions Due to Service Error:

   · If a transaction fails or is not completed due to an error or technical glitch in our application, the process for investigating the case will be described and, if valid, reversing the transaction or crediting the corresponding funds to the user's account.

3. Cancellation Policy:

   · Conversions and Purchases: Once a user initiates a conversion from traditional funds to a native token (or vice versa) and confirms the transaction, the transaction generally cannot be canceled due to market volatility and the immediacy of the process

   · Subscriptions or Premium Services: If you offer subscriptions, the cancellation process and any prorated refunds will be detailed.

4. Problem Reporting Process:

   · The user will be instructed to immediately contact customer support (info@gapstation.ca) in the event of an erroneous or unwanted transaction, providing all details (transaction ID, amount, date/time).

   · Timelines will be established for the initial response and investigation.

5. Exceptions:

   · It will be clarified that refunds will not be issued for changes in the market value of the native token or cryptocurrency, or for user errors when entering wallet addresses.
